DMCA Copyright Policy
Effective Date:
The Handwritium Archive respects the intellectual property rights of others. Our platform is dedicated to curating and preserving media that is in the public domain or available under open-access licenses. However, we recognize that mistakes can happen.
If you believe that your copyrighted work has been copied or hosted on the Archive in a way that constitutes copyright infringement, we are committed to resolving the issue swiftly and in good faith pursuant to the Digital Millennium Copyright Act ("DMCA").
1. How to Submit a Takedown Notice
To request the removal of allegedly infringing content, please send a written communication (via email) to our Designated Copyright Agent. To be valid under the DMCA, your notice must include the following information in writing:
- Your Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright interest.
- Identify the Original Work: A description of the copyrighted work that you claim has been infringed.
- Identify the Infringing Material: A clear description of where the material that you claim is infringing is located on the Archive. (Please provide specific URLs so we can locate the exact file).
- Your Contact Information: Your address, telephone number, and email address.
- Good Faith Statement: A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law (e.g., it is not "fair use").
- Accuracy Statement: A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
2. Where to Send Your Notice
Please send all DMCA takedown requests directly to our support team via email. We monitor this inbox regularly and will process valid requests as quickly as possible.
Designated Copyright Agent: Resteer John L. Lumbab
Email Address: support@archive.handwritium.org
Subject Line: Please use "DMCA Takedown Request" to ensure priority handling.
3. Counter-Notices
If you are a user who believes that material you contributed was removed by mistake or misidentification (for example, you have proof the material is verifiably in the public domain), you may file a counter-notice. Please contact us at the email above with your reasoning, the URL of the removed material, and a statement under penalty of perjury that the removal was a mistake.
4. Repeat Infringer Policy
Because the Handwritium Archive is a curated platform operated by a central team rather than a user-upload platform (like YouTube), we actively vet the public domain status of the files we index. If we discover that a source we pull from repeatedly violates copyright law, we will permanently sever our connection to that source to protect the integrity of the Archive.
5. Let's Just Talk
As stated in our Terms & Conditions, we are just people trying to archive historical and public media. If you are an independent author or creator and find your work here by mistake, you do not need to hire a lawyer to send us a formal legal threat. Just email us, point out the file, and we will take it down immediately. We value communication and respect creators.
