Legal
Terms & Conditions
Effective Date:
Welcome to the Handwritium Archive (the "Archive," "Platform," "we," "us," or "our"). These Terms & Conditions ("Terms") are an agreement between you and the Archive Operator, governing your access to and use of this website.
By accessing the Archive, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, you must immediately cease using the Platform.
1. Purpose of the Archive
The Handwritium Archive is designed to be a streamlined, high-performance interface for accessing, reading, listening to, and viewing media that is widely considered to be in the Public Domain or available under open-access licenses. We act as a digital repository and streaming interface, organizing publicly available data into an accessible format.
2. Legal Compliance and Aesthetic
Users are advised that this Platform utilizes specific visual themes that may be described as gritty, industrial, or "cult bunker" aesthetics. This is purely a design choice to enhance user experience and does not imply any connection to real-world organizations, ideologies, or illegal activities. By using this site, you agree not to misinterpret or misrepresent the visual aesthetic of the site as anything other than artistic expression.
3. Intellectual Property Rights
3.1 The Media (The Content)
We do not claim ownership over the books, audio files, or video files hosted on the Platform. The vast majority of this content is believed to be in the Public Domain within the United States and many other global jurisdictions.
However, copyright laws vary significantly by country. If you access this site from outside the United States, you are solely responsible for compliance with your local laws. We do not warrant that the content is free of copyright restrictions in your jurisdiction.
3.2 DMCA & Copyright Takedowns
If you are a copyright owner or an agent thereof and believe that any content on the Archive infringes upon your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act (DMCA). Please visit our dedicated DMCA Page for full instructions on how to submit a valid takedown notice. We expeditiously process valid claims of infringement.
3.3 The Platform (The Interface)
While the hosted media may be in the public domain, the Archive's specific aggregation, organization, database structure, custom code, graphics, design, aesthetic "look and feel," and the "Handwritium" logo remain the intellectual property of the Archive Operator. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes only.
4. User Conduct & Use of Platform
You agree to use the Archive only for lawful purposes. You are strictly prohibited from:
- Using the Platform to violate any local, state, national, or international law or regulation.
- Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Platform.
- Taking any action that imposes, or may impose at our sole discretion, an unreasonable or disproportionately large load on our infrastructure (e.g., automated "scraping" of files).
- Engaging in any conduct that restricts or inhibits any other user from using or enjoying the Platform.
5. User Data & Local Storage
A key descriptive feature of this Archive is our commitment to privacy. The Platform does not utilize traditional user accounts or backend databases to store your personal information.
Instead, features like **"Favorites," "Reading History," and "Settings Preferences"** are stored exclusively in your browser's native Local Storage on your specific device. You acknowledge that this data belongs to you. We do not transmit, backup, or maintain any control over this data. If you clear your browser cache or switch devices, this data will be lost. We are not responsible for any loss of user-generated data stored locally.
6. Warranty Disclaimer ("As Is" and "As Available")
The Archive Operator provides the Platform and its content on an "as is" and "as available" basis, without any warranties of any kind, either express or implied.
Without limiting the foregoing, we explicitly disclaim:
- Any warranties concerning the accuracy, completeness, legality, reliability, or availability of the hosted content.
- Any warranties that the Platform will meet your requirements, operate without interruption, or be secure or error-free.
- Any warranties that the servers that make the content available are free of viruses or other harmful components (though we take reasonable measures to ensure security).
You download or otherwise obtain content through the Platform at your own discretion and risk.
7. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall the Archive Operator (Resteer John L. Lumbab), its affiliates, or licensors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to your use of, or inability to use, the Platform.
Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.
8. Indemnification
You agree to defend, indemnify, and hold harmless the Archive Operator from and against any claims, damages, obligations, losses, liabilities, costs, and expenses arising from your use of the Archive or your violation of any copyright or legal obligation in your specific jurisdiction.
9. Resolving Issues & Good Faith Communication
We aren't a massive faceless corporation with a team of corporate lawyers; we are just trying to preserve and share public domain history. If you have an issue, a dispute, or a concern regarding the Platform or its content, we ask that you simply talk to us first.
Reach out via email, explain the situation, and we will do our absolute best to resolve things fairly, reasonably, and in good faith without the need for courts, legal threats, or formal proceedings. We value communication over litigation.
10. Severity and Waiver
If any provision of these Terms is found to be invalid or unenforceable, the invalidity of such provision shall not affect the validity of the remaining provisions, which shall remain in full force and effect.
11. Contact Operator
If you have any questions, concerns, or simply want to reach out to discuss an issue regarding these Terms, please contact the operator directly:
